National Platinum is a “members only” on-line merchandise shopping service.
It is not a bank or a financial institution, nor is it affiliated in any way with a bank or
financial institution.
This Agreement contains information about the use of this Member Account and explains the
terms in which both you and we agree to be bound by. In this Agreement the words “I”,
“My”, and “Me” mean the Member. “We”, “The Company”,
and “Charge Account” mean National Platinum located in Casper, Wy.
This Agreement describes the Terms and Conditions under which my account is issued. I certify
that I an at least 18 years of age and the information I provided to obtain this charge account
is true and accurate. I understand that my use of the account constitutes my
acceptance of this charge account in accordance with the terms of this Agreement.
I understand that, as a new member, my account is being opened with No Credit Check or Investigation
and, as a result of this, I will be required to make a reasonable down payment (normally 50% or
less) towards my merchandise purchases from the authorized catalog site. The minimum
monthly payment required on my outstanding charge balance is $10.00 or 10% of the
outstanding balance, whichever is greater. See “Minimum Monthly Payment” heading for
complete explanation.
RETURNED AND NSF ACH PAYMENTS: I agree that in the event that my required down payment
is returned due to Non-Sufficient Funds, National Platinum may attempt to collect fee by
automatically resubmitting to my bank. Any subsequent withdrawal attempts by National Platinum
will not exceed the original down payment amount. Furthermore, I agree and understand that if
National Platinum is unable to successfully process my electronic payment, National Platinum will not
process the merchandise order.
CHARGE ACCOUNT – CREDIT LIMIT: My account has been issued with a starting
credit limit, which is indicated on the Account Information Form.
MEMBER INFORMATION CHANGES: Members must allow the debiting of the monthly membership
fee from their checking account. In the event of changes to their checking account information
and this fee cannot be collected, membership will cease. It is the members’ obligation
to contact National Platinum promptly in the event of such changes in banking information or
change of residency, phone number, etc.
CREDIT BUREAU REPORTING: National Platinum nor any of its affiliated websites report to
any credit bureau. Establishment of an account will not aid in the improvement of your credit
rating.
CHARGE PURCHASES AND MONTHLY BILLING: I will be billed each month for charges made to
my account. My Account must be maintained on a current basis to make additional credit
purchases and to receive additional Member benefits.
PROMISE TO PAY: I agree to pay at least the minimum payment amount shown on each billing
statement. All payments must be received on or before the due date indicated on the billing
statement.
APPLICATION OF PAYMENTS RECEIVED: Payments received are always applied to any unpaid
balance. Payments are applied towards purchases in the same order they were made, older
purchases first.
MINIMUM MONTHLY PAYMENT: The minimum monthly payment which must be paid every month
(as long as my account shows an outstanding balance) is computed by finding the greater of
(a) or (b): a) 10% of the account balance owed immediately following any purchase made to my
account, or b) $10.00, whichever is greater. This figure is the minimum monthly payment. The
minimum monthly payment does not automatically reduce as my account balanced reduces. Should
my new balance be less than $10.00, the payment due will be the amount of the new Balance.
DELINQUENT ACCOUNT: My account is considered delinquent if National Platinum does not
receive the Minimum Payment by the due date.
DEFAULT ON ACCOUNT: I will be in default if: a) I fail to pay the “minimum monthly
payment” when due; or b) I breach any of the Terms and Conditions of this Agreement. If I
am in default, then upon compliance with applicable law, National Platinum has the right to: a)
demand me to pay the entire unpaid balance on the account immediately; b) apply monies received
to subsequent purchases to any delinquent account balance owed, and /or c) proceed with legal
action.
RETURN AND REFUND POLICY: All merchandise offered by National Platinum carries a 100% full
replacement warranty. No cash refunds on merchandise purchases will be given. However, a
credit to your account of the amount of the purchase will be given in the event that there is no
available replacement product or the member does not wish to receive replacement product.
CANCELLATION OF ACCOUNT: Your account membership will be cancelled in the event that the
monthly membership fee is not paid. If the member wishes to cancel membership, he/she may do so
by contacting National Platinum and no further membership fees will be debited. In the event of
cancellation, the member will lose all buying privileges from National Platinum.
SECURITY INTEREST: National Platinum, to the extent legally permissible, retains a security
interest in all merchandise charged on this account until balance paid in full.
APPLICABLE LAW: The law of the State of Georgia covers this Agreement.
MEMBERSHIP IN GOOD STANDING REQUIREMENT: I understand that my charge privileges, current
charge limit, current down payment requirement, or other member benefits and/or special
promotions/programs are subject to my maintaining my account in good standing by making my
minimum monthly payments on time. Should I become delinquent on my account, or in default, then
I understand that my privileges and benefits may be changed and/or suspended until I have
re-established a consistent pattern of on-time monthly minimum payments.
I certify that I have read, understand and agree to all the Terms and Conditions and Disclosures
written in this Agreement. I certify that all the information I provided is true, accurate and
verifiable. The information provided herein is accurate as of November 2002. The information may
be changed after that date. If the member does not agree with any changes in the terms and
conditions of the member account, the member may close their account without incurring any
penalty. Please note that the member will be responsible for paying all outstanding balances
in the event they close their account. Terms and conditions of this program may be modified
and Services and Benefits may be added or deleted at any time without notice.
RENEWAL: There is no renewal fee required for this membership. Membership will be
perpetual as long as monthly membership fee is paid.
OPTIONS: At any time during the membership period, National Platinum may offer
additional products, services, or benefits to members.
DEBITS: All debits will be initiated by a licensed ACH provider on behalf of National Platinum.
